California Harassment Prevention — What the Law Requires

Key statutes every California employer must know.

FEHA — Gov. Code §12940

California's core anti-harassment and discrimination law. Applies to ALL employers regardless of size. Prohibits harassment, discrimination, and retaliation based on 20+ protected characteristics.

AB 1825 — Gov. Code §12950.1

Requires 2-hour supervisor training. Originally applied to employers with 50+ employees. Effective 2005. Renewed every 2 years. Supervisors personally liable for harassment they engage in.

SB 1343 (2018)

Expanded training to ALL employees at employers with 5+ employees. 1 hour for non-supervisory employees, 2 hours for supervisors, every 2 years. New hires within 6 months of hire date.

AB 2053

Added 'abusive conduct' training requirement — systematic bullying, public humiliation, or hostility even without a protected class basis. Required alongside AB 1825 supervisor training.

2 CCR §11023

CRD/DFEH regulations: training must be interactive (not just a video), trainer must be qualified under §11024, specific content requirements, Q&A mechanism required.

Gov. Code §12954 (Cannabis)

Protects employees from adverse action based on lawful off-duty cannabis use away from work premises. Relevant for all employers — critical for cannabis industry clients.
