Harassment Prevention (MOD101)

Common IIPP compliance questions from California employers.
Every employer is required — even with one employee?
Yes. 8 CCR §3203 and Labor Code §6401.7 require ALL California employers with at least one employee to maintain a written IIPP. There are no exemptions based on size, industry, or business type. A sole proprietor with one part-time employee must have an IIPP.
What happens if Cal/OSHA inspects and we don't have an IIPP?
Cal/OSHA inspectors will cite each missing IIPP element as a separate violation. A completely missing IIPP can result in a single citation for the program itself, plus individual citations for each of the 9 required sections that are not addressed. Willful violations — where the employer knew about the requirement and ignored it — carry penalties up to $25,000 per violation.
How is the IIPP different from the WVPP (Workplace Violence Prevention Plan)?
The IIPP (8 CCR §3203) is a general safety program covering all workplace hazards — required since 1991. The WVPP (Labor Code §6401.9 / SB 553) is a specific program focused on workplace violence — required since July 2024. Both are required for California employers. Having one does not satisfy the other. BizHR.org can deliver both.
What triggers a Cal/OSHA inspection?
Cal/OSHA conducts both complaint-driven and programmed (random) inspections. Triggers include: employee complaints (anonymous), work-related fatalities (mandatory inspection), serious injuries reported within 8 hours, referrals from other agencies, and targeted industry programs. High-hazard industries (construction, agriculture, healthcare, cannabis) face higher inspection frequency.
